This recorded conference discusses how food companies routinely use claims to inform consumers about specific product attributes that help consumers distinguish the food from others on the market. Claims highlighting the whole grain content, the presence of fruit, vegetable or other valuable components, the level of trans fat, "natural claims" and many others are found in the marketplace. Food companies and retailers also have developed programs that help consumers more easily identify "healthier" foods. As these claims proliferate, there have been increasing challenges to the use of these claims by regulators, competitors and consumer groups.
This program explores the federal, state and private rights of actions governing the use of claims. FDA, state regulators, members from the private bar and representatives from the National Advertising Division (NAD) of the Better Business Bureau will provide their perspective on the applicable laws and the factors they consider when evaluating potentially false or misleading claims.
